Mark Hertsgaard is the author of the highly acclaimed study of the media during the Reagan years, "On Bended Knee" and "Earth Odyssey; Around the World in Search of Our Environmental Future." On Sept. 11, 2001, Hertsgaard was traveling around the world asking people questions about America. Interviewer Terrence McNally recently spoke with him about his new book, "The Eagle's Shadow: Why America Fascinates and Infuriates the World."
I remember in Antwerp one night, there was a debate set-up by the major Dutch language paper in Belgium... it was me, the former Prime Minister of Belgium—who is a center-right politician—and the former head of NATO, who is another Belgian. Of course we all talked in English and I couldn’t help noticing that this center-right politician was farther to the left than any of the mainstream Democrats in this country. That just shows you how utterly anomalous the American political system is. We think here that we’ve got two parties and one’s conservative and one’s liberal. In the European context, the Republicans would be a right-wing party and the Democrats would be maybe a center-right party.
I also think back to a guy I interviewed in Holland who said, “Look, I vote for the most conservative party in Holland and they’re way to the left of your Democrats.”
I think Jim Hightower has the right idea, going around the country with his Rolling Thunder Revue, organizing people. We need to recognize that we are the majority. Most people agree that the minimum wage should be increased to a living wage, that Social Security should stay intact, that women should have freedom of choice, that we should have a national health care system. But we've been out-organized by the right. It's really that simple.

Today, more than 23,000 representatives of private industry
are working quietly with the FBI and the Department of Homeland Security.
The members of this rapidly growing group,
receive secret warnings of terrorist threats before the public does --
and, at least on one occasion, before elected officials.
In return, they provide information to the government, which alarms the ACLU.
But there may be more to it than that.
One business executive, who showed me his InfraGard card,
told me they have permission to "shoot to kill" in the event of martial law.

Thom Hartmann’s “The Big Picture” TV show - http://www.thomhartmann.com/tv
Hartmann is a true believer in the power of media to convert the skeptic to the progressive point of view, and his radio guests are mostly conservatives, whom he debates with gusto, armed with an historian's knowledge of America's distant and recent past.
"I think many of them come for the same reason that I'm having them on, which is that they believe in their cause and they know that having a debate is one of the most effective ways to get the word out, because...people love genuine debate," Thom explains. "This isn't gratuitous bullshit debate like 'Crossfire' [the famed CNN show of the 1990s] used to be. We try to do genuine debate about real issues that we really care about. It's not just Republicans and Democrats throwing talking points and politicians yelling at each other. And...I think they do our show because they know that I don't do ad hominems."
Indeed, "The Thom Hartmann Program" is an unusual mix of substantial subject matter with the high energy and on-air calls from listeners that define the tried-and-true talk radio format. Thom is passionate about maintaining that mix, believing it a format that can change minds: "I just got an e-mail today from a guy who said, 'I've just been listening to your show for a couple of weeks and I want to tell you it's the best radio show on the air and I love it so much. And, by the way, I'm a die-hard conservative but I'm not listening to Limbaugh anymore because I can predict what he's going to say and I'm learning from you.' My prediction is that in a year I'm going to get an e-mail from him saying, 'I used to be conservative.' Because it happens constantly. Literally constantly. People call into the show or send e-mails or post on our message board, 'I thought I understood politics until I started actually listening.'"

Murder, Spies & Voting Lies (The Clint Curtis Story) (2008) - (68 min./total video)
One way or the other, make sure that you
everyone else that you know)
see this extremely important documentary!
[Info about the documentary from www.BradBlog.com ]:
"After the Florida Election in 2000, one man found himself on the wrong end of a smoking gun."
That's the tagline for Murder, Spies & Voting Lies: The Clint Curtis Story,
the brand-new documentary film by Patty Sharaf which has now finally been released!
Kansas City Star is among the first out of the box to review the film,
calling it a "Must See!"
and declaring that it "plays like a high-tension political thriller."
The terrifying feature-length documentary, shot in high-definition video, details, for the first time,
the complete Clint Curtis/Tom Feeney/Yang Enterprises vote-rigging scandal,
in all of its, yes, sometimes very gory detail.
It also tells a tale of the media,
as it details my attempts to tell the story over the last four years,
to a corrupt, detached, and too-often frightened corporate media.
The BRAD BLOG broke the Curtis story originally in late 2004,
and we've been investigating and reporting on it ever since.
[Here’s the Link TV URL for the 1-min. promo for the ‘MSVL’ documentary.]:

Journalist Brad Friedman (Bradblog.com) pokes at the seamy side of American democracy in this beautifully filmed documentary.
Whistle-blower Clint Curtis, a computer programmer by trade,
sticks to his claims that he was asked to make vote-rigging software for electronic voting machines
by former US Congressman and loyal Bushite,Tom Feeney (R-Fl).
Tension rises when the vote-rigging scandal dips into a murder mystery.
While Clint Curtis testified to a Congressional Judiciary committee caucus in December 2004,
and passed a lie detector test shortly thereafter, mainstream media has paid scant attention to his story.
Independent filmaking is filling that gap.
Memorable personalities emerge in the documentary:
attorney Bob Fitrakis who sued for a recount in Ohio,
social critic Gore Vidal, former Congresswoman Cynthia McKinney,
and researcher Richard Hayes Phillips.
Security expert Harri Hursti explains the shocking internal shortcomings of problem voting machines.
Not to be missed.

As we have documented, Koch not only financed the rise of the anti-Obama Tea Party,
he has also helped guide the movement to support the narrow business priorities of his conglomerate Koch Industries:
and Koch’s Americans for Prosperity hands out Tea Party talking points attacking clean energy.
Building on this research, the Los Angeles Times reported this weekend about the central influence of Koch in the new GOP Congress.
According to the Times, just before David Koch spoke to ThinkProgress

he had met with Boehner in the Speaker’s office.
Koch’s top political deputy, former Jack Abramoff operative Tim Phillips,

MARK KARLIN, BUZZFLASH EDITOR FOR TRUTHOUT
It's amazing that many middle-class Americans fall for the siren song that government is the source of all evil
when many global corporations are putting US citizens out of work;
sitting on profits generated by gullible consumers; and polluting our air, water and food.
That's why the Koch brothers are the latest in a long line of ultra-wealthy, right-wing investors
in running the federal government through owning politicians and financing propaganda
that diverts attention from corporate misdeeds.
Koch Industries will have to spend a lot - billions of
dollars, perhaps -
if climate change laws are passed or regulations put into effect.
Not to mention that the Koch brothers represent
a whole wing of billion-dollar corporate polluters who want the EPA to be defanged.
As a result, the Republicans, particularly in the House,
have marked the EPA as one key target
in budget reduction -
and vigorously oppose protecting us from global warming.
The Republican strategy of attacking the deficit
is a shrewd move to reduce positive restraints on corporations.
In the financial sector, for instance,
this means Republican proposals to cut the budgets of agencies
that regulate banks and Wall Street.
The Koch brothers know how to fund front organizations
to stir up Americans who feel displaced
by inciting them with emotional diversions.
It's a magic trick, of sorts, to distract our eyes
while our pockets are picked and our lungs are filled with toxins.
No, things don't go better with the Koch brothers.
In fact, they will get a whole lot worse.
Nine Pictures of the Extreme Income/Wealth Gap
(Truthout - 2-14-11)
Smoking Gun - Roadway Surveillance Cameras’ “Stand-Alone” Agenda:
There was an article on the front page of the Sunday, Aug. 29, 2010, St. Louis Post-Dispatch entitled, “Green lights are a work in progress” -- with the subtitle, “Region’s 3-year plan includes millions to coordinate more traffic signals.” Near the end of the article (on the continuation on page 16A), there was a brief mention that:
“…. Few additional signals will be added to the network. Instead, future upgrades will include adding surveillance cameras…” [Bold emphasis added.]
From what can be readily observed, the surveillance cameras "upgrades" program is disturbingly well under way throughout the St. Louis Metro area. The tall pole, 360-degree, inverted black-dome surveillance cameras have now been installed at many intersections, and all along numerous state and county roads in St. Louis County and adjacent counties.
A brand new, 4-way intersection -- constructed where there was no previous roadway intersection -- was recently opened (in early 2011) just east of I-270 on Dorsett Road and Old Dorsett Road in Maryland Heights (St. Louis County), Missouri. A 360-degree, inverted black-dome surveillance camera was installed at that brand new intersection, along with four brand-new “regular” traffic-light cameras, too! (So much for the “surveillance cameras” merely being an “upgrade” to the system…they obviously have another “stand-alone” agenda!)
[Note: There are additional installations of tall-pole, 360-degree, inverted black-dome surveillance cameras now at many of the roadway intersections throughout Maryland Heights; as well as all along I-270 and other roadway connectors throughout the Metro area. --BikeBob]
As these 360-degree, inverted-black-dome surveillance cameras are now becoming ubiquitous, there are some serious violations of privacy concerns to be considered. Through the use of augmented infrared vision, these surveillance cameras also can “see in the dark.” These surveillance cameras are also capable of seeing extreme detail (example: being able to tell whether or not you have shaved) from a distance of a mile or two away! So, if you live within direct-line-of-sight of one of these surveillance cameras, it would be wise to keep your window blinds closed!
But, no need to be that concerned…“they” can’t watch everything/everybody all the time…can they? Actually, YES “they” can, AND do! These surveillance cameras utilize 24/7 digital streaming video -- which is real-time archived to computer servers. Real-time analysis of the digital video stream is being constantly done automatically via software…”red-flag” tagging any “suspicious activity.” Additionally, it must be kept in mind that ALL the 24/7 digital-stream images/video is permanently archived on computer hard drives. Anything/everything the cameras “see” is part of the “permanent record.”
Finally, here’s a pertinent excerpt on the subject. The excerpt is taken from the Sunday, April 13, 2008, Washington Post article, “The Government Is Trying to Wrap Its Mind Around Yours,” which was written by Nita Farahany, who is an assistant professor of law and philosophy at Vanderbilt University, and is the editor of "Genes and Justice: The Impact of Behavioral Genetics and Neuroscience on Criminal Law." [Emphasis added]:
Consider Cernium Corp.'s "Perceptrak" video surveillance and monitoring system, recently installed by Johns Hopkins University, among others. This technology grew out of a project funded by the Defense Advanced Research Projects Agency -- the central research and development organization for the Department of Defense -- to develop intelligent video analytics systems. Unlike simple video cameras monitored by security guards, Perceptrak integrates video cameras with an intelligent computer video. It uses algorithms to analyze streaming video and detect suspicious activities, such as people loitering in a secure area, a group converging or someone leaving a package unattended. Since installing Perceptrak, Johns Hopkins has reported a 25 percent reduction in crime.

Russ Feingold Launches 'Progressives United'
Combat Corporate Influences In Politics
(2-16-11 - Amanda Terkel/Huffington Post)
WASHINGTON -- When some senators retire, they decide to take lucrative lobbying jobs.
Others go straight to Wall Street.
But Wisconsin Democrat Russ Feingold, who lost his re-election bid in November,
is continuing on his principled -- and often lonely -- path
by starting an organization to combat corporate influence in politics,
an effort he hopes will spark "a new progressive movement" that will truly hold elected officials accountable.
Launching on Wednesday,
Progressives United is an attempt to to build a grassroots effort
aimed at mitigating the effects of,
and eventually overturning,
the Supreme Court's infamous decision
that opened the floodgates to corporate spending in the U.S. electoral system.
In addition to online mobilization,
the political action committee (PAC)
will support progressive candidates at the local, state and national levels,
as well as holding the media and elected officials accountable on the
group's key priorities.

“The Pentagon’s $36 billion black budget is a license to steal. In BLANK CHECK, Pulitzer Prize-winning Tim Weiner tells the entire, shocking story.” --- U.S. Rep. Patricia Schroeder, (D., Colo.), member, House Armed Services Committee
[From the book’s inside flyleaf]:
BLANK CHECK is the story of the Pentagon’s secret budget—the black budget. A remarkable work of investigative reporting, this book presents the first detailed look into the multibillion-dollar cache used to fund every defense program, every espionage mission, every weapon, and every war that the President, the Secretary of Defense and the Director of the CIA want erased from the public ledger and shielded from public debate.
Over the past three years, the black budget has consumed more than $100 billion -- $100 million a day. In blatant defiance of the United States Constitution, this system of secret spending has stripped Congress of its power over the federal budget and robbed taxpayers of their right to know how their money is spent.

Spying on Internet Users - Beware the government's avatars, especially fear your own
(Feb. 23, 2011) - By Wayne Madsen
‘The Department of Homeland Security is conducting massive spying on Internet users through a program called "Avatar Identity." The existence of the program was disclosed to WMR by a source who stated that the development of avatars for every user of the Internet had its beginnings with the U.S. Air Force and the Advance Research Projects Agency (ARPANET) at the outset of the fielding of World Wide Web (WWW) technology in the early 1990s.
At the core of Homeland Security's Avatar Identity Program is the reliance on genetic algorithms developed for the analysis of the stock market to come up with prime investment strategies. The program was developed through the aegis of the Homeland Security Advanced Research Projects Agency (HSARPA), which inherited many of the invasive Internet surveillance programs from its Pentagon cousin, the Defense Advanced Research Projects Agency(DARPA), after its programs, including the proposed Total Information Awareness program, were defunded by Congress
The Avatar Identity Program appears to coincide with another Air Force project to solicit "persona management software" to create virtual users on the Internet in order to conduct perception management campaigns to inundate chat rooms, letter to the editor, and on-line polls to sway public opinion on key issues.’
‘…. The program matches recommendations from White House Office of Information Regulatory Affairs chief Dr. Cass Sunstein, who has referred to such operations as "cognitive infiltration."
However, Homeland Security's Avatar Identity program involves the creation of an avatar for every Internet user that pulls information from the actual user's Google searches, Twitter messages, Facebook postings, on-line commerce activities, and other web interactions and feeds the transactions to the avatar program. Intelligence analysts then query the avatar for details of the user's activities.’ - http://www.opinion-maker.org/2011/02/spying-on-internet-users/
How One Nuclear Skirmish
Could Wreck the Planet
WASHINGTON — Even a small nuclear exchange
could ignite mega-firestorms and wreck the planet’s atmosphere.
New climatological simulations show
100 Hiroshima-sized nuclear bombs
— relatively small warheads, compared to the arsenals military
superpowers stow today —
detonated by neighboring countries
would destroy more than a quarter of the Earth’s ozone layer in about two years.
Regions closer to the poles
would see even more
precipitous drops in the protective gas,
which absorbs harmful ultraviolet radiation from the sun.
New York and Sydney, for example,
would see declines rivaling the perpetual hole in the ozone layer above Antarctica.
And it may take more than six years
for the ozone layer to reach half of its former levels.
Researchers described the results during a panel Feb. 18
calling it “a real bummer” that such a localized nuclear war
could bring the modern world to its knees.
“This is tremendously dangerous,”
said environmental scientist Alan Robock of Rutgers University,
one of the climate scientists presenting at the meeting.
“The climate change would be unprecedented in human history,
and you can imagine the world … would just shut down.”

NY Times Report: Fracked Water Thousands of Times More Dangerous Than They're Telling Us
(February 28, 2011 - By Steven D. | Sourced from Booman Tribune) - http://mcaf.ee/b5f7d
Good old hydrofracking. You know about it right? It's the method to produce natural gas by fracturing rock formations with millions of gallons of water and toxic chemicals. It's been contaminating groundwater in the Western US for many years and now it is being pursued with a vengeance in the East, particularity with respect to the Marcellus Shale formation that extends across Pennsylvania and New York.
Everyone in the know has warned us for years that hydrofracking was highly dangerous to sources of groundwater used for human consumption. But only now are we being told how much worse is that contamination of our water supplies. So bad it will make you ill after you read this investigative report from the NY Times:
With hydrofracking, a well can produce over a million gallons of wastewater that is often laced with highly corrosive salts, carcinogens like benzene and radioactive elements like radium, all of which can occur naturally thousands of feet underground. Other carcinogenic materials can be added to the wastewater by the chemicals used in the hydrofracking itself.
While the existence of the toxic wastes has been reported, thousands of internal documents obtained by The New York Times from the Environmental Protection Agency, state regulators and drillers show that the dangers to the environment and health are greater than previously understood.
The documents reveal that the wastewater, which is sometimes hauled to sewage plants not designed to treat it and then discharged into rivers that supply drinking water, contains radioactivity at levels higher than previously known, and far higher than the level that federal regulators say is safe for these treatment plants to handle.

The Seattle Times Calls For Pot Legalization… - (March 1, 2011 - Alternet) - On Friday, February 18, the Seattle Times editorial board opined in favor of House Bill 1550, which legalizes and regulates the “production, distribution, and sale” of marijuana to adults. (You can contact your state elected officials in support of the measure here.) The editorial, titled “The Washington Legislature should legalize marijuana” did not mince words.
Marijuana should be legalized, regulated and taxed. The push to repeal federal prohibition should come from the states, and it should begin with the state of Washington.
… Some drugs have such horrible effects on the human body that the costs of prohibition may be worth it. Not marijuana. This state’s experience with medical marijuana and Seattle’s tolerance policy suggest that with cannabis, legalization will work — and surprisingly well.
Not only will it work, but it is coming.
According to Seattle Times editorial page editor Ryan Blethen, the public’s reaction to the paper’s pot-friendly position was overwhelming. - http://mcaf.ee/049b3

finding eager buyers in the Middle East

The Smug Wealthy
Have Gone Too Far --
We're Finally Fighting Back
(March 6, 2011 - Michael Moore)
By trying to destroy us
has given birth to a movement --
a movement that is becoming a massive,
nonviolent revolt across the country.
Contrary to what those in power
would like you to believe
so that you'll give up your pension, cut your wages,
and settle for the life your great-grandparents had,
America is not broke.
Not by a long shot.
The country is awash in wealth and cash.
It's just that it's not in your hands.
It has been transferred,
in the greatest heist in history,
from the workers and consumers
to the banks and the portfolios of the uber-rich.
Today just 400 Americans have more wealth than half of all Americans combined.
Let me say that again.
400 obscenely rich people,
most of whom benefited in some way
from the multi-trillion dollar taxpayer "bailout" of 2008,
now have more loot, stock and property
than the assets of 155 million Americans .
If you can't bring yourself to call that a financial coup d'état,
then you are simply not being honest about
what you know in your heart to be true.
…the refusal to halt our relentless destruction of the ecosystem on which life depends are the harbingers of our own collapse and the consequences of the idiocy of our elite and the folly of globalization. Protests that are not built around a complete reconfiguration of American society, including a rapid dismantling of empire and the corporate state, can only forestall the inevitable. We will be saved only with the birth of a new and militant radicalism which seeks to dethrone our corrupt elite from power, not negotiate for better terms.
The global economy is built on the erroneous belief that the marketplace—read human greed—should dictate human behavior and that economies can expand eternally. Globalism works under the assumption that the ecosystem can continue to be battered by massive carbon emissions without major consequences. - http://www.commondreams.org/view/2011/03/07-0
Do genes make people evil? - (March 8, 2011 - Scientific American) - By Daniel Lametti, a neuroscientist at McGill University
Since the 1960s psychologists have found that children who were abused and neglected are more likely to commit crimes later in life. Even so, researchers noted that most youngsters who are mistreated do not grow up to be criminals. Now our genes come into the picture.
A 2002 study found that a particular variation of a gene predicted antisocial behavior in men who were mistreated as children. The gene controls whether we produce an enzyme called monoamine oxidase A (MAOA), which at low levels has been linked to aggression in mice. The researchers found that boys who were neglected and who possessed a variation of the gene that produced low levels of MAOA were more likely to develop antisocial personality disorder, commit crimes and grow up to have a violent disposition. But those living in a similar environment who produced more of the enzyme rarely developed these problems.
Psychopaths are arguably the evilest of the evildoers. A study published in August 2010 looked at psychopathic tendencies in teenagers with low socioeconomic resources. The researchers found that adolescents who had a variation of another gene, which contributes to how quickly serotonin is recycled in the brain and which has been linked to hostile behavior in children, were more likely to exhibit signs of psychopathy.
These two recent findings provide strong evidence that evil behavior—mass murder, armed robbery, and perhaps even newspaper theft—might be caused by the right set of genes interacting with the wrong environment. - http://www.scientificamerican.com/article.cfm?id=do-genes-make-people-evil

Al Franken: ‘They're coming after the Internet’ - (3/14/11 - By MIKE ZAPLER) - AUSTIN, Texas — Sen. Al Franken claimed Monday that big corporations are "hoping to destroy" the Internet and issued a call to arms to several hundred tech-savvy South by Southwest attendees to preserve net neutrality.
"I came here to warn you, the party may be over," Franken said. "They're coming after the Internet hoping to destroy the very thing that makes it such an important [medium] for independent artists and entrepreneurs: its openness and freedom.”
Net neutrality, he added, is "the First Amendment issue of our time." - http://www.politico.com/news/stories/0311/51266.html

Later that year, Silkwood was found to be contaminated with 400 times the legal limit for plutonium. Silkwood contended that she had been exposed to the plutonium as retaliation for her whistleblowing.
Having arranged to turn over papers that would have allegedly showed the culpability of Kerr-McGee for multiple risks at the nuclear plant, she was killed when her car ran off the road while she was en route to meet a New York Times reporter. No documents were found in her car and the circumstances of the accident indicated that Silkwood may have been rammed from behind.
In a civil trial, Kerr-McGee made the rather difficult-to-believe claim that Silkwood intentionally poisoned herself with plutonium. Subsequently, 44 pounds of plutonium were found missing from the plant. - http://blog.buzzflash.com/node/12508/
NSA’s Treasure Trove - “The Quiet Zone” was originally broadcast on the (up until then) popular weekly “Wired Science” PBS television show on Dec. 26, 2007. Without any explanation or notice, that was the very last time “Wired Science” appeared on PBS.
The video segment is 10 minutes long. While the entire video is well worth watching -- with the first half essentially covering radio astronomy, the most important part is the last half (beginning at about 6-1/2 minutes in) which exposes -- for the very first time for public view -- the NSA (National Security Agency) “Naval Security Group Activity” (land-locked) Sugar Grove, West Virginia, domestic “listening post” which covers the entire spectrum of electromagnetic communications.
During this last-half of the video, James Bamford -- author of three books on the NSA -- details some of the capabilities of the NSA’s Sugar Grove site. While he particularly highlights the facility’s “domestic surveillance” capabilities (which, by the way, such use by the NSA is proscribed by law…in other words: illegal), he does not mention that it is a major part of NSA’s “ECHELON” program.

What It's Like Living in Our Nuclear Sacrifice Zone - (March 21, 2011 - The Phoenix Sun / By Valerie Brown - http://tinyurl.com/65f48e8 ) -
The official focus on high short-term doses is deceptive. Emerging science suggests that low doses of radiation exposure can have numerous long-term effects, possibly passed from one generation to the next. And almost all the discussion about – and the scientific research on – radiation exposure focuses on cancers. There are certainly many cancers that radiation can induce in addition to thyroid cancer, from breast and prostate cancer to various leukemias. These cancers are thought to result from energetic particles striking DNA, breaking strands, and interfering with gene replication. Faulty genes lead to faulty cells, is the thinking. But there may also be epigenetic effects – that is, changes in the way normal genes are organized and allowed to function – and these may result in disorders other than cancer, such as thyroid diseases, autoimmune problems, and hormones gone haywire.
To make matters worse, how old you are when you’re exposed makes a big difference too. Prenatal insults including chemical and radiation exposure can create epigenetic patterns of gene expression that will stay with you forever, even if your actual genes are undamaged. And it can take 50 or more years for the timer set in the womb to trip the fuse and trigger a full-blown disease.
In a 2009 review article, Canadian researchers Carmel Mothersill and Colin Seymour of McMaster University nicely expressed the emerging state of knowledge about the effects of low-level radiation exposure:
“Our understanding of the biological effects of low dose exposure has undergone a major paradigm shift….[W]e understand, at least in part, some of the mechanisms which drive low dose effects and which perpetuate these not only in the exposed organism but also in its progeny and in certain cases, its kin. This means that previously held views about safe doses or lack of harmful effects cannot be sustained.”
Turns out that at
. . . Los Alamos National Laboratory [LANL]
nuclear safety issues have been complicated with seismic concerns
as geological studies have uncovered
an increasingly precarious underground structure. . . .
in the late 1990s [faults were] found to run near
and even beneath some LANL nuclear facilities. . . .
A survey found a number of LANL buildings
to be at considerable risk of earthquake-induced collapse.
But this information
. . . was not immediately applied to building siting and design . . . .
"When they set up Los Alamos initially,
they didn't care about these things.
They were looking for an isolated site,"
said [Greg] Mello [of the Los Alamos Study Group],
who has studied seismic issues at the lab since 1996. . . .
"Since then, many people have questioned the wisdom
of putting a plutonium processing facility
and now a nuclear pit manufacturing facility
on the side of a volcano."
The Legal Threat of Being SLAPPed
[SLAPP] - Overview> - [excerpt]
Partner, Kaplan Kirsch & Rockwell
Short of a gun to the head, a greater threat to First Amendment expression can scarcely be imagined. — Judge J. Nicholas Colabella (1992)
Strong statement or overstatement? Judge Colabella was referring to the threat posed by Strategic Lawsuits Against Public Participation, or "SLAPPs." SLAPPs are lawsuits filed in response to or retaliation for citizen communications with government entities and employees.
Citizens have been sued for testifying before their city councils and county commissions, about building permit and zoning change applications, for expressing concerns to school board members, and for reporting violations of environmental laws to regulatory agencies, to give just three of thousands of examples. In short, these citizens were sued for doing exactly what the Constitution allows and encourages them to do, which accounts for Colabella’s strong words in Gordon v. Marrone, a 1992 New York case.
The particular provision of the First Amendment that is threatened by SLAPPs is the petition clause ("Congress shall make no law" abridging the "right of the people" to petition the Government for a redress of grievances"). George Pring and Penelope Canan, the authors of the leading work on the topic, SLAPPs: Getting Sued for Speaking Out (and the coiners of the acronym), have dubbed the petition clause "the unknown soldier of the Bill of Rights."
While the petition clause may be less renowned than the First Amendment’s guarantees of free speech, press and religion, the right it protects is every bit as basic to our form of government. - http://www.firstamendmentcenter.org/petition/topic.aspx?topic=slapp

Debut of the First Practical 'Artificial Leaf' - ScienceDaily (Mar. 28, 2011) — Scientists have claimed one of the milestones in the drive for sustainable energy -- development of the first practical artificial leaf. Speaking in Anaheim, California at the 241st National Meeting of the American Chemical Society, they described an advanced solar cell the size of a poker card that mimics the process, called photosynthesis, that green plants use to convert sunlight and water into energy.
"A practical artificial leaf has been one of the Holy Grails of science for decades," said [MIT professor] Daniel Nocera, Ph.D., who led the research team. "We believe we have done it. The artificial leaf shows particular promise as an inexpensive source of electricity for homes of the poor in developing countries. Our goal is to make each home its own power station," he said. "One can envision villages in India and Africa not long from now purchasing an affordable basic power system based on this technology."
The device bears no resemblance to Mother Nature's counterparts on oaks, maples and other green plants, which scientists have used as the model for their efforts to develop this new genre of solar cells. About the shape of a poker card but thinner, the device is fashioned from silicon, electronics and catalysts, substances that accelerate chemical reactions that otherwise would not occur, or would run slowly. Placed in a single gallon of water in a bright sunlight, the device could produce enough electricity to supply a house in a developing country with electricity for a day, Nocera said. It does so by splitting water into its two components, hydrogen and oxygen.
The hydrogen and oxygen gases would be stored in a fuel cell, which uses those two materials to produce electricity, located either on top of the house or beside it. - http://www.sciencedaily.com/releases/2011/03/110327191042.htm

Federal agency proclaims medical use for marijuana - (3-24-11 - By Kyle Daly - The Washington Independent) - As federal battles over medical marijuana across the country heat up, a statement from one federal agency may be a huge asset for medical marijuana dispensaries that have been targeted by the various arms of the U.S. Department of Justice and the IRS.
The National Cancer Institute (NCI) is a division of the National Institute of Health, which is itself one of the 11 component agencies that make up the U.S. Department of Health and Human Services. Last week, the NCI quietly added to its treatment database a summary of marijuana’s medicinal benefits, including an acknowledgment that oncologists may recommend it to patients for medicinal use.
The summary cites clinical trials demonstrating the benefit of medical marijuana. Part of it reads:
The potential benefits of medicinal Cannabis for people living with cancer include antiemetic effects, appetite stimulation, pain relief, and improved sleep. In the practice of integrative oncology, the health care provider may recommend medicinal Cannabis not only for symptom management but also for its possible direct antitumor effect. - http://mcaf.ee/6df12

‘Predator’ Smart Camera Locks Onto, Tracks Anything … Mercilessly - (4-1/4 min. - YouTube audio/video) - (April 4, 2011 - by Charlie Sorrell- Wired) - Zdenek Kalal’s Predator object-tracking software is almost uncanny. Show anything to its all-seeing camera eye, and it will quickly learn to recognize it and then track it, whether it fades into the distance, hides amongst other similar objects or — in the case of faces turns sideways.
It really lives up to its name, reminding us of the Predator’s HUD-enhanced vision in the movie of the same name.
Kalal is a Ph.D. student at the University of Surrey in England, researching projects that make computers see. His Predator algorithm is both fast and powerful.
After telling it what to look for (by dragging a box over the onscreen image) the Predator gets to work. Within seconds it can recognize patterns, objects and faces and track them as they shrink, grow and rotate. When Kalal hides from the camera and holds up a sheet of paper with his photo among a patchwork of thumbnails, Predator picks his face out immediately.
Four minutes might seem like a long time in today’s attention-starved world, but you should watch Kalal’s demo video. It’s worth it just to see him scooting hyperactively around on his office chair.
Keep watching past the credits and you’ll see plenty of other uses, such as tracking individual animals for research, and chasing cars and people across multiple security cameras. It’s not hard to imagine more. -
How I Almost Got Put on the Domestic Terrorist List for Handing Out Leaflets - (March 28, 2011 - Alternet) - Will Potter explains how confronting animal abuse made the government target him as a terrorist -- and taught him to never hide from those who try to silence him.
The following is an excerpt from The Next Eco Warriors: 22 Young Women and Men Who Are Saving The Planet, edited by Emily Hunter (Conari Press, 2011).
Few activists will be visited by the FBI, even fewer will be arrested.
The real purpose of all this—the FBI visits, the public relations campaigns,
the legislation—is to instill fear and make everyday people afraid of speaking
up for their beliefs. The scare-mongering has had what attorneys call a
chilling effect: it has made everyday people feel as if they must choose
between their activism and being labeled a terrorist, and that is not a choice
anyone should have to make.
It can be unsettling and frightening to learn how far the government has gone to attack political activists, and sometimes I wonder if spreading this information simply makes more people afraid. But time and again, in dozens of venues, from the New York City Bar Association to anarchist bookstores, I have seen an incredible thing happen when people learn about these issues and then turn to their neighbors. Their conversations are never about how they are afraid; they are about how they are angry and want to take action. - (Will Potter is an award-winning independent journalist based in Washington, DC. He has just released his first book, Green Is The New Red, from City Lights Books.) - http://mcaf.ee/da246

Cops Spot Bad Guys in a Crowd Using Cyborg-Style Shades - (April 14, 2011 - By Christina Bonnington - Wired) - … “RoboCop” glasses, which can identify a criminal’s face in a crowd of people.
“To the naked eye, two people may appear identical,” says Major Leandro Pavani Agostini, chief of military police in Sao Paolo. But these powerful shades can scan up to 400 faces per second, up to 50 yards away, using 46,000 biometric points to identify an individual and ensure a correct match.
Faces are scanned with a tiny camera in the glasses then checked against a database of known criminals. A red light pops up if a perpetrator is found, and the cop can apprehend them without the need for questioning or requesting documents.
The settings of the glasses are adjustable, so if a crowd is more sparse and spread out, it can identify faces as far as 12 miles away at a slower rate. - http://www.wired.com/gadgetlab/2011/04/cops-cyborg-shades/
Take Michael Dell, founder of Dell Computers and the second-richest Texan, who qualified for an agricultural property tax break on his sprawling 1,757-acre residential ranch in suburban Austin and saved over $1 million simply because his family and friends sometimes use the land as a private hunting preserve to shoot deer. Or take billionaire publisher Steve Forbes, who got more than a 90 percent property tax reduction on hundreds of acres of his multimillion-dollar estate in upscale Bedminister, New Jersey, just by putting a couple of cows out to pasture. They are not alone. All across the country, a huge number of America’s wealthiest are tapping into agricultural tax breaks—and none of them have to do any real farming to qualify.
Not only are agricultural tax breaks allowing wealthy landowners to shift their tax burden onto other less-affluent taxpayers but they are also helping bankrupt public schools, which derive the bulk of their funding from local property taxes. - http://www.thenation.com/article/159943/tax-day-farms-owned-rich-provide-massive-tax-shelter

Reed and Phillips go way back; the two were partners in Century Strategies, the political consulting group through which Reed played a role in the Jack Abramoff bribery scandal. Tainted uranium, danger widely distributed - (6-24-01 - by Peter Eisler - USA TODAY) - For years, state investigators wondered why radioactive technetium-99 was turning up in drinking water wells near the old Mallinckrodt Chemical uranium fuel-making plant in Hematite, Mo. Now they think they have an answer: The plant was one of several in and around St. Louis where Mallinckrodt and its successors used thousands of tons of recycled uranium to fabricate metallic fuel rods for nuclear reactors. "We believe the contamination we're now seeing at the site is related to the (recycling) program," says Ron Kucera of the Missouri Department of Natural Resources. Plans to clean up extensive pollution from uranium wastes at Hematite are snagged by questions over who is responsible for the technetium. That element requires special disposal because it has a half-life of 213,000 years and moves easily into soil and water. Technetium wasn't expected at Hematite because it is produced only when uranium is irradiated in a nuclear reactor — and Hematite had no reactor. "The Department of Energy has resisted efforts to become involved because even though they may have some liability, they don't want to pay anything," Kucera says. The Hematite facility was part of a nationwide network of private and federally owned plants and labs that produced fuel and other components for the nearly 70,000 U.S. nuclear weapons built before production was phased out in the early 1990s. Many of them used recycled uranium. The recycling began at the dawn of the Cold War. Officials in the weapons program were seeking ways to reuse the costly uranium that was irradiated in nuclear reactors to make plutonium and other fissile explosives for bomb cores. - http://www.usatoday.com/news/poison/2001-06-25-hotnukes.htm

Private capital tends to become concentrated in few hands, partly because of competition among the capitalists, and partly because technological development and the increasing division of labor encourage the formation of larger units of production at the expense of the smaller ones. The result of these developments is an oligarchy of private capital the enormous power of which cannot be effectively checked even by a democratically organized political society.

"Shock Doctrine" Economics Ruining America - (May 7, 2011 - by Stephen L. Goldstein - The South Florida Sun-Sentinel) - WARNING: Reading Naomi Klein's "Shock Doctrine: The Rise of Disaster Capitalism" will disturb your sleep and haunt your waking hours. If you're a real American, it will make you want to scream — and do something to put "the bad guys" in their place. Everyone — especially Milton-Friedman, free-market lovers like Kingsley Guy — should read "Shock." If enough people do so, it could save the country. If they don't, our democratic/representative government and capitalism will be permanently replaced by the un-American, corporate-socialist state that has already taken hold — and it will be our own fault.
A high-level player with one of the most notorious narco-trafficking organizations in Mexico, the Sinaloa “cartel,” claims that he has been working with the U.S. government for years, according to pleadings filed recently in federal court in Chicago.
That player, Jesus Vicente Zambada Niebla, is the son of Ismael “El Mayo” Zambada Garcia — one of the purported top leaders of the Sinaloa drug-trafficking organization. Zambada Niebla was arrested in Mexico in March 2009 and last February extradited to the United States to stand trial on narco-trafficking-related charges.
The indictment pending against Zambada Niebla claims he served as the “logistical coordinator” for the “cartel,” helping to oversee an operation that imported into the U.S. “multi-ton quantities of cocaine … using various means, including but not limited to, Boeing 747 cargo aircraft, private aircraft … buses, rail cars, tractor trailers, and automobiles.”
The revelation that Zambada Niebla claims to have been a U.S. government asset, working with its sanction, is a shocking development in the so-called drug war and has gone largely un-reported by the U.S. media. The claim, if true, adds credence to theories long in play that the Mexican and U.S. governments are essentially showing favor toward the Sinaloa drug organization and its leadership, including El Mayo and Joaquin “El Chapo” Guzman Lorea, as part of a broader strategy to weaken and ultimately eliminate rival narco organizations. U.S. and Mexican government officials, of course, have consistently denied that any such arrangement is in place. - http://mcaf.ee/eotpi

The New American Century (2009) - (1 Hr & 34 Mins - This is the Complete Full Movie - YouTube audio/video) - https://www.youtube.com/watch?v=2Fk6qkHs0oM&feature=related
“THE NEW AMERICAN CENTURY explores the historical, philosophical and economic
background that suggests a matrix for such events that is much closer to home
than the so-called "Islamic terrorism".
The film provides solid evidence for the true reasons behind the Afghanistan and Iraq wars, whose unfolding is described in chilling detail in a document called "Project for the New American Century", published in the year 2,000, that seems to have served as the actual blueprint for such dramatic events.
As a follow-up to Inganno Globale, The New American Century presents the historical, philosophical, economical and political background -- some of which is totally unknown to the public -- that lend support to the accusation that the 9/11 terrorist attacks were in fact an inside-job.
"Historically accurate, narratively captivating, The New American Century is one of the best films about the facts behind the 9/11 attacks". -- Webster G. Tarpley
"The New American Century is a stunning film. It should be seen as widely as possible, in cinemas, bars, clubs, at meetings and, of course, through the internet. I'm sure the film will continue to be a source of debate and political education for many years." -- Ken Loach.
This film is astonishing, it goes in detail through the untold history of The Project for the New American Century with tons of archival footage and connects it right into the present. This film exposes how every major war in US history was based on a complete fraud with video of insiders themselves admitting it. This film shows how the first film theaters in the US were used over a hundred years ago to broadcast propaganda to rile the American people into the Spanish-American War. This film shows the white papers of the oil company Unocal which called for the creation of a pipeline through Afghanistan and how their exact needs were fulfilled through the US invasion of Afghanistan. This film shows how Halliburton under their "cost plus" exclusive contract with the US Government went on a mad dash spending spree akin to something out of the movie Brewster's Millions, yet instead of blowing $30 million they blew through BILLIONS by literally burning millions of dollars worth of hundred thousand dollar cars and trucks if they had so much as a flat tire. I have seen a ton of films, this film contains a massive amount of incredible footage I have never seen before anywhere, it is an historical documentary which exposes all the lies of the past so that you can understand the present. - This film is a must see”

DEADLY SPIN: An Insurance Company Insider Speaks Out on How Corporate PR Is Killing Health Care and Deceiving Americans - [book] - Since Wendell Potter walked away from his executive position at a top health insurance company in May of 2008, he has worked tirelessly as an outspoken critic of corporate PR and the distortion and fear manufactured by America’s health insurance industry. It is a PR juggernaut that is bankrolled by millions of dollars, rivaling lobbying budgets and underwriting many “non-partisan” grassroots organizations. How would Potter know? He wrote many of the industry’s talking points himself.
From clandestine meetings carefully organized to leave no paper trail to creating third party front groups, Potter lets the reader in on the dirty secrets most big corporations would rather have the masses be in the dark about because the stakes are high and the profits even higher.
DEADLY SPIN is not just an exposé of health insurers but a stark warning that corporate spin is distorting our democracy. - http://mcaf.ee/vukat
The Bikenomics Series - (2011) - Bicycle transportation is good for a lot of things—it’s healthy, it’s green, it’s quiet, it’s fun, it builds community. It also makes financial sense, and the magnitude of bicycling’s economic impact gets far less attention than it deserves. In the grassroots and on a policy level, the bicycle is emerging as an effective engine of economic recovery. - https://www.grist.org/article/series/bikenomics

The Koch Brothers are Now Buying Professors to Spread
the Gospel of Greed - (5-10-2011 by Mark Karlin on - Truthout) - The Koch brothers
pretty much own the Tea Party; they pretty much own a lot of right-wing think
tanks that have steered the nation toward a radical Ayn Rand vision of the
world; and now they are buying up professors and dictating extreme right-wing
Yes, ThinkProgress reports that the Koch Foundation reached an agreement in 2008 to fund professors at Florida State University, as long as they would teach right-wing economic theory. In fact, the Koch Foundation had to approve any faculty hires who were paid with its "donated" funds.
The Saint Petersburg Times reports:
A foundation bankrolled by Libertarian businessman Charles G. Koch has pledged $1.5 million for positions in Florida State University's economics department. In return, his representatives get to screen and sign off on any hires for a new program promoting "political economy and free enterprise."...
Under the agreement with the Charles G. Koch Charitable Foundation, however, faculty only retain the illusion of control. The contract specifies that an advisory committee appointed by Koch decides which candidates should be considered. The foundation can also withdraw its funding if it's not happy with the faculty's choice or if the hires don't meet "objectives" set by Koch during annual evaluations.
In short, what is happening at a public university in Florida is the sellout of open inquiry by replacing it with corporate control of the faculty and the curriculum - and an extremist one at that.
If this is a harbinger of things to come in our cash-starved public institutes of higher learning, it may signal the end of academic freedom at institutes of higher learning. They could become nothing more than propaganda diploma mills. - http://blog.buzzflash.com/node/12682

A look at the "sovereign citizen" movement - Byron Pitts reports on a movement the FBI now considers one of the nation's top domestic terror threats - (May 15, 2011 - Transcript - 60 Minutes/CBS)
(CBS News) This is a story about a group of Americans you've likely never heard of: they're called "sovereign citizens." Many don't pay taxes, carry a driver's license or hold a Social Security card. They have little regard for the police or the courts, and some have become violent.
The FBI lists them among the nation's top domestic terror threats.
By some estimates, there are as many as 300,000 sovereign citizens in the U.S. And with the sluggish economy and mortgage mess, their ranks are growing. - http://www.cbsnews.com/stories/2011/05/13/60minutes/main20062666.shtml
Sheds New Light on NSA’s Warrantless Wiretapping and Data Mining - (May 16, 2011 - By Kim Zetter - Wired) - New details about the NSA’s post–Sept. 11 domestic surveillance programs have emerged in a stunning New Yorker article about NSA whistleblower Thomas Drake, who faces trial next month for allegedly leaking information about waste and mismanagement at the agency.
The article provides new insight into the warrantless surveillance program exposed by The New York Times in December 2005, including how top officials at the intelligence agency viewed the program. Former NSA Director Michael Hayden, in 2002, reportedly urged a congressional staffer who was concerned about the legality of the program to keep quiet about it, telling her that she could “yell and scream” about the program once the inevitable leaks about it occurred.
Asked why the NSA didn’t employ privacy protections in its program, Hayden reportedly told the staffer, “We didn’t need them. We had the power,” and admitted the government was not getting warrants for the domestic surveillance.
The New Yorker also spoke with a former head of the agency’s Signals Intelligence Automation Research Center, or SARC, who invented software codenamed ThinThread that is believed to have been adapted by the NSA for the warrantless surveillance. The program had privacy protections built into it, but the official says he believes the NSA rejiggered the program to remove those protections, so that it could collect data on everyone, including people in the United States. - http://www.wired.com/threatlevel/2011/05/new-yorker-on-thomas-drake/

Eli Pariser: "The Filter Bubble" - (51-1/4 min. - audio - May 17, 2011 - The Diane Rehm Show/NPR) - A quiet revolution is taking place on the Internet. The top 50 websites collect an average of 64 bits of information each time we visit. The personal data they track -- from our politics to the shoes we just browsed on Zappos – help advertisers tailor offers just for us. But one online pioneer believes we pay a big price for that customized experience – living in our own information universe. In our so-called “filter bubble,” we receive mainly familiar news that confirms our beliefs. And we don’t know what’s being hidden from us. Diane and her guest, Eli Pariser, talk about understanding the costs of online personalization.
Billboards that target you in real time - (4-30-11 - by Caitlin Petre - The Filter Bubble) - We knew this day would come, if only because we saw Minority Report: A new NYC-based start-up, Immersive Labs, makes outdoor ads that scan your face as you approach and guess your age and gender. Combining this info with data about the weather and nearby social media activity, Immersive’s billboards then serve up the ad most likely to get your attention. They gauge success by measuring how long your eyes linger on the chosen ad. And the system gets smarter with each new passer-by.
While these ads raise obvious privacy concerns, Immersive Labs CEO Jason Sosa told the Huffington Post that they don’t save face-scans or collect any personally identifiable information. Still, one wonders how far companies like Immersive are going to take this. Right now, the ads just scan for age and gender, but might they one day add, say, race or body-mass index to that list? If they can pick up Foursquare and Twitter data, will they soon personalize ads based on data pulled from your mobile phone as you walk by?
Of course, targeted ads are nothing new — we’re used to seeing them pretty much all over the Internet. But Immersive’s ads raise the question: is there something about the very public nature of a billboard that sets it apart from other forms of targeting?
(Caitlin Petre is a PhD student in the Sociology Department at NYU, where she studies how the migration of news to the internet is changing journalistic ethics and practices. Caitlin's writing has appeared in Newsday, Newsweek and the Albuquerque Journal.) - http://www.thefilterbubble.com/billboards-that-target-you-in-real-time
A Former Jerry Falwell Follower Reflects On How The Religious Right Gets It Wrong - (May, 2011 - by Jason Childs - Church & State) - I want you to know that the fundamentalist political movement is the beginning of a cultural revolution that will take our nation to a very dark place. You have to understand that this has been methodically planned and is being carried out with the utmost vigilance. In accordance with their worldview, my old friends do not in the least care about what you think. They are against democracy, and they are seeking to end the rule of the majority in our great country.
They truly believe that if you
have not been “saved,” you are living under a curse and are incapable of
knowing what is best and that because of this you should be ruled over. You
should also know they do not believe that even centuries-old Christian
communities (Catholics, Anglicans, Greek Orthodox, etc.) are “saved,” only
those who think like they do.
You might be thinking that a minority fundamentalist group of zealots can’t really take over the direction of a society. Just look at Iran, or the countless other places where people have allowed this to happen. Are you all really going to sit back and watch this happen? They will begin to attack all sources of accurate information. Public radio was first, next will be museums and then science books. Just listen to them argue against the scientific facts about the peril our planet is facing, because it does not fit in with their ideas. They represent a clear and present danger to our union. - http://www.au.org/media/church-and-state/archives/2011/05/conversion-story.html

Jon Stewart and Actual Historian Refute Beck Fave, David Barton, on Religion and Law - (May 19, 2011 - Sourced from Right Wing Watch - Alternet) - University of Pennsylvania historian Richard Beeman was yesterday’s guest on The Daily Show with Jon Stewart following an appearance by pseudo-historian David Barton. Beeman, like other real historians, notes that Barton greatly embellishes the religious views of the Founding Fathers and misrepresented the Constitution.
“The Constitution is federally devoid of any mention of religion except for one provision which says there shall be no test for public office or any position of public trust, so the only mention of religion is keep religion out of our government,” Beeman says, and “the debate in the [constitutional] Convention is virtually devoid” of religious references. Barton, on the other hand, made this pathetic case that the Constitution incorporates the Bible.
Right Wing Watch looked into Barton’s many fabrications, falsehoods, obfuscations, revisionist history, as well as his total neglect of the Fourteenth Amendment’s incorporation of the First Amendment to the states and his warped view of constitutional jurisprudence while he was on The Daily Show.
During part II of the interview with Beeman, Stewart noted that while Barton told him that he was OK with Sharia law in the US, he would likely make the opposite case to his conservative supporters.
Such dishonest actions reflect the fact that Barton is a political activist, not a historian -- he even was paid by the Republican National Committee to mobilize church groups to support President Bush’s reelection and Republican candidates. As Kyle notes, even his documentary on African American history is brazenly partisan.

From allergies to deadly disease, feeling the effects of climate change - (13-1/2 min. video - May 20, 2011 - by Laura LeBlanc - Need To Know/PBS) - http://mcaf.ee/p26b3 - A rare but deadly fungal disease once occurring only in tropical climates has recently led to several deaths in the Pacific Northwest. Scientists believe that climate change may be to blame.
When doctors discovered that Trudy Rosler, a Canadian, had a fungus growing in her brain system, they were stumped. The fungus was previously only known to exist in the tropics. But because of climate change, it’s infecting people much farther north. Here in the U.S., the Centers for Disease Control and Prevention is already treating climate change as a serious health threat.
Need to Know’s medical correspondent Dr. Emily Senay examines how a warming climate is already affecting our health, from making allergies worse to affecting the spread of infectious diseases and pushing the extremes of killer weather.
